Tree Removal under CDC

A faster approval pathway for tree removal that forms part of a residential development in NSW.

A Complying Development Certificate (CDC) is a fast-tracked planning and construction approval that can be used for tree removal when the removal is part of a residential development with minor environmental impact. Use our Tree Removal Guide to confirm whether the CDC pathway applies to your tree.

What is a CDC?

A Complying Development Certificate is a fast-tracked approval process that can be used for certain types of development that meet specific state-wide criteria. Unlike a DA — which is assessed at council's discretion — CDC requirements are "black and white" and apply consistently across NSW. A CDC application can be determined by either council or a private certifier.

When can a tree be removed under CDC?

Your tree cannot be removed under CDC if:

  • The tree trunk is not wholly within your property.
  • The tree is on a Biodiversity Values Map.
  • The tree is on the council's register of significant trees, is located in a heritage area, or is in a heritage conservation area.

Your tree may be removed under CDC if:

The tree removal is part of a CDC for residential development and one of the following applies:

  • The tree's canopy structure is no bigger than 25 square metres.
  • The distance between the proposed building and the base of the trunk is less than 3 metres.
  • The development is for a new dwelling and the tree is not taller than 8 metres.
  • The development is for alterations and additions and the tree is not taller than 6 metres.

If none of the above criteria apply, a DA is required. See our Tree Removal under DA guide.

How to apply for a CDC in NSW

Before starting an application, we recommend contacting your registered certifier or local council to confirm that your plans can be submitted as Complying Development. The CDC pathway is only available where the specific criteria above are met.

  1. 1

Open the NSW Planning Portal and select "Apply online".

  2. 2

Create an account or log into the Planning Portal.

  3. 3

Provide the required information about your property and the proposed development.

  4. 4

Upload the requested documentation, including plans showing the tree's location relative to the proposed works.

  5. 5

Review and confirm all information, complete the declarations, and submit your application.

Speak to your certifier first The CDC pathway is only suitable where your project clearly meets the criteria above. If there is any doubt, a DA may be more appropriate — or you may need a DA for the tree removal separately from a CDC for the building works.
